ARBITRATION
The Terms of Use will be governed and construed in accordance with the laws of the State of Iowa without giving effect to any conflicts of laws’ provisions. You and Yummy Toddler Food mutually agree to waive our respective rights to resolution of disputes in a court of law by a judge or jury and agree to resolve any claim or dispute against each other on an individual basis in arbitration, except as expressly otherwise provided in this section. Any controversy or claim arising out of or relating to the Terms of Use, or the breach thereof, shall be exclusively settled by arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of any such arbitration shall be in or near Centre County, PA.. The parties also agree that the AAA Optional Rules for Emergency Measures of Protection shall apply to the proceedings. You understand, acknowledge, and agree that you and Yummy Toddler Food are each waiving the right to sue in court or have a jury trial for any and all covered matters, except as expressly otherwise provided in this arbitration agreement. To opt-out of this arbitration clause, you must email yummytoddlerfood@gmail.com stating your request within thirty (30) days of accessing this website for the first time.
MISCELLANEOUS PROVISIONS
If any provision(s) of the Terms of Use is held to be invalid, illegal or unenforceable, the remaining provisions shall be severable and enforceable. If a provision is excessively broad, such a provision shall be limited or reduced in scope so as to be enforceable.
